Incremental capacity project: Czech-Austrian connection

Information on the completion of the procedure initiated in 2019 for incremental capacity for the border between Austria and the Czech Republic 

The transmission system operators of Austria (Gas Connect Austria) and the Czech Republic (NET4GAS) inform, that in the annual auction for incremental capacity for the border between the Czech Republic and Austrian Market Area East, which took place on 4 July 2022, according to the Regulation (EU) 2017/459 (NC CAM)  and on the basis of approval of the incremental capacity project made by decisions of the respective national regulatory authorities, both TSOs offered two common offer levels of incremental capacity for bundled capacity at IP Reintal.

No amount of incremental capacity for any offer level was booked by any market participant in the abovementioned annual auction and therefore the economic test ended with a negative result on both sides of the Austrian-Czech border.

According to Art. 22(3) of CAM NC in case no offer level results in a positive outcome of the economic test, the specific incremental capacity process shall be terminated.

Incremental capacity project on the border between the Czech Republic and Austria 

Based on its obligation according to Art. 25 (2) and Art. 28 (3) Regulation (EU) 2017/459 (NC CAM) and in connection with the upcoming annual capacity auction NET4GAS is publishing the following documents related to the incremental capacity project on the border between the Czech Republic and Austria (Market Area East):

NET4GAS also informs, that the project proposal was approved by the decision of the Energy Regulatory Office no. 10036-42/2020-ERU issued on 30th September 2021. For more details, please, see the article below dated 27th October 2021.

NET4GAS emphasizes that signing of the above-attached Contract for Provision of Gas Transmission Service by 27th June 2022 at the latest is the basic precondition for participation in the auction of the incremental capacity at the IP Reintal scheduled on 4th July 2022.

The final decision on the updated project proposal for incremental capacity  

The Czech Energy Regulatory Office has issued a decision regarding the incremental capacity project on the border between the Czech Republic and the Austrian Market Area East. In that regard and in accordance with Art. 25 (2) and Art. 28 (3) of Commission Regulation (EU) 2017/459, the Czech Energy Regulatory office has published the following documents on its webpage:

ACER grants ERO and E-control an extension to reach an agreement on the Czech-Austrian incremental capacity project proposal  

On 26 July 2021, The EU Agency for the Cooperation of Energy Regulators (ACER) has accepted the request for an extension submitted by the Energy Regulatory Office and the Austria’s national regulatory authority - Energie-Control Austria für die Regulierung der Elektrizitäts- und Erdgaswirtschaft, on the project proposal for incremental capacity between the entry-exit systems of the Czech Republic and the Austrian Market Area East. In its decision, the Agency allows the regulatory authorities to reach an agreement on the project proposal by 5 November 2021.

Postponement of the decision on the Project proposal for incremental capacity between the entry-exit systems of the Czech Republic and the Austrian Market Area East 

 On 20 April 2021, the Energy Regulatory Office received information from Austria’s national regulatory authority - Energie-Control Austria für die Regulierung der Elektrizitäts- und Erdgaswirtschaft, that it will not be possible on the Austrian side to issue the decisions necessary for the approval of the Project by 5 May 2021. For this reason, both national regulatory agencies have decided to submit a request for the extension of the deadline for the abovementioned decision. NET4GAS acknowledges this decision and informs that it results in its inability to offer the incremental capacity related to the project in 2021 auction of yearly transmission capacities. We will keep you informed about developments in the affairs of this project on our website.

Project proposal for incremental capacity

In accordance with Article 28 of the Commission Regulation (EU) 2017/459 of 16 March 2017 establishing a network code on capacity allocation mechanisms NET4GAS has submitted a proposal for the incremental capacity project between the Czech Republic and Austria to the Energy Regulatory Office (ERO) for approval. The project proposal has been prepared in cooperation with the Austrian TSO, Gas Connect Austria (GCA). However, GCA will submit the final version of the Austrian part of the project proposal to the Austrian national regulatory authority later, in accordance with GCA’s time schedule.

The project proposal for ERO consists of the documents listed below.

Within six months of receipt of the project proposal, the ERO shall publish a joint decision on the proposal of the incremental capacity project in coordination with Austrian national regulatory authority.
